Terms and Conditions

These terms apply to the use of the Finden24 platform. They describe the actual scope of the service and name open points expressly as such.

1. Scope and definitions

These terms apply between Blagoy Ivanov as the operator of the platform and the people who use it.

Finden24 is the name of the platform and is not a company. The contracting party is solely the operator named in the imprint.

“User” means any person who uses the platform. “Listing” means content placed by a user. “Content” means all texts, images, videos and files that are placed.

2. The role of the platform

The platform provides the technical means to publish content, to search and to get in touch with one another.

Contracts concerning the goods and services offered are concluded solely between the users involved. The operator does not become a party to those contracts and owes neither the service offered nor its quality, lawfulness or availability.

This is to be distinguished from the platform’s own services — plans, paid extras and fees. In that respect there is a contractual relationship directly with the operator.

3. Account, eligibility and age

An account is required in order to publish content and to use personal functions. The details given on registration must be accurate.

Credentials are to be kept confidential and must not be passed on to third parties.

The adult area additionally requires age confirmation and is accessible only to persons of full age.

The account can be deleted at any time in the settings.

4. Listings and publisher responsibility

The person who places content is solely responsible for it. This applies to descriptions, images, prices, personal details and statements about qualifications and authorisations.

Details must be accurate, and the offer must genuinely exist.

E-mail addresses and links are not permitted in free text. Contact details belong in the fields provided for them.

New listings are reviewed before publication and are not publicly visible until they are approved. There is no entitlement to publication.

5. Prohibited content

Prohibited content includes, in particular, content that breaches applicable law, infringes the rights of others, is misleading or instructs in criminal conduct.

Also prohibited are offers of goods and services whose trade is forbidden or requires authorisation, where the necessary permission is not held.

Also prohibited is content harmful to minors, where it is placed outside the area expressly provided for it.

Attempting to move other users off the platform before anything has been agreed, and the automated bulk collection of content, are likewise prohibited.

6. Review, reporting, removal and suspension

Content is reviewed before publication. The operator may reject, hide or remove content, or suspend an account, where there is a breach of these terms or of applicable law.

The person affected is informed of such a measure; moderation decisions are logged.

In the adult area a report form is available on every listing.

7. Private and commercial use

When an auction is created, a declaration must be made as to whether the sale is private or commercial. That declaration is permanently attached to the individual auction and is shown to interested parties.

The declaration must be truthful. Anyone acting commercially owes consumers the statutory warranty and a right of withdrawal; those obligations fall on the selling person, not on the operator.

Anyone acting commercially must also meet the information duties that apply to them.

8. Plans

The platform can be used on the free basic plan, Free. Beyond that, the paid plans Plus, Pro and Business are available.

What a plan includes and what it costs is shown before the order and becomes part of the contract with the order. The details shown during the order process govern.

Plans run for the period selected. Once a plan ends, the services it contained are no longer available; the presentation of content already published may be restricted as a result.

9. Paid extras

Additional services can be booked for individual listings, such as a highlighted presentation, preferred placement, greater reach or an extension of the running time.

The scope, duration and price of each service are shown before the order and become part of the contract with the order.

Extras affect how a listing is presented. No particular outcome — such as a number of views, enquiries or a sale — is owed.

10. Contact and dealings between users

Contact is made through the platform’s messaging function or through the routes given in the listing.

Arrangements, payments and fulfilment take place directly between those involved. The operator takes no part in them, holds no purchase money and does not act as an escrow agent.

We recommend keeping arrangements in the messaging function until a deal is concluded, and sharing personal details only once that is necessary.

11. Product auctions

In a product auction an item is offered for a fixed period. Interested parties register to take part and place bids.

A bid, once placed, is binding. Under the auction rules the highest valid bid at expiry wins.

A fee applies for creating an auction; a fee may apply for taking part. The amounts and the duration options are shown before the order.

The contract of sale for the item auctioned is concluded between the selling and the winning person. Fulfilment — payment, handover and shipping — takes place directly between them.

The platform’s fees are independent of whether that transaction is concluded and carried out.

12. Construction auctions

In a construction auction the client describes a project. After review, suitable businesses may take part and submit offers.

A fee applies for publication. It is initially only reserved and is charged only when publication is approved.

An offer, once submitted, is binding. The contract for the work is concluded between the client and the business engaged.

There is no obligation to accept an offer.

13. Super auctions

The super auction is a separate format for special items. A submission is reviewed before publication.

The conditions are set for the individual case and agreed before publication. There is no entitlement to admission to this format.

14. Payments, fees and taxes

Only the platform’s own services are chargeable: plans, paid extras and the fees for the auction formats named above.

The amount payable is shown before the order process is completed. Payment is made through the providers offered during that process.

For a construction auction the amount is initially reserved and is charged when publication is approved.

The tax treatment of these charges has not yet been finally determined and will be completed before launch. We deliberately make no statement here about VAT rather than make one that has not been reviewed.

15. Right of withdrawal

Consumers generally have a statutory right of withdrawal in respect of contracts concluded at a distance.

The final withdrawal notice for the platform’s paid services — including the question of whether and how early commencement of the service is agreed — is still outstanding and will be completed before launch.

Until then we reproduce no withdrawal notice here. A notice that has not been reviewed would be worthless to you and unreliable for us.

16. Video ads

In a video ad a video takes the place of the images. A declaration must be made that the necessary rights in the video are held; that declaration is stored.

The scope and price are shown before the order. The video is reviewed before publication.

Identifiable people may be shown only with their agreement.

17. Food orders

At participating businesses the menu can be viewed and an order put together. The order is transmitted to the business concerned.

The menu, the prices, availability, the information on ingredients and allergens and the delivery areas are set and answered for by the business itself. Whether delivery is available follows from the postcodes the business has entered; a minimum order value and a delivery fee may apply.

The platform transmits the order and prepares it technically. Preparation, handover and, where applicable, delivery are performed by the business.

Who is legally the seller of the food in an order has not yet been finally settled and will be determined before launch.

18. Adult area (18+)

This area is accessible only to persons of full age and only after age confirmation. The confirmation applies to the browser being used.

Listings in this area may be placed only from accounts cleared for it. An ordinary account cannot publish here.

The rules in these terms apply unchanged to content in this area; prohibited content remains prohibited. A report form is available on every listing.

19. Rights in content you place

The rights in content placed remain with the person who placed it.

The operator receives the right to store, technically process and display that content to the extent required to operate the platform — in particular in overviews, in search and on the detail page.

That right ends in so far as the content is removed. Any use beyond this, in particular for the operator’s own advertising away from the platform, does not take place without separate agreement.

20. Availability and changes

The platform is operated with due care. Uninterrupted availability is not promised; maintenance and faults may lead to temporary restrictions.

Functions may be developed further, changed or discontinued. Paid services are unaffected for the period already paid for.

21. Liability

Liability is unlimited for intent and gross negligence, and for damage arising from injury to life, body or health.

In cases of simple negligence liability arises only on breach of a material contractual duty, and is limited in amount to the foreseeable damage typical of the contract.

No liability is accepted for the content, statements and conduct of other users, or for the contracts concluded between them.

Statutory claims remain unaffected.

22. Termination and account deletion

The account can be deleted at any time in the settings. Services already paid for end with the account.

The operator may end the relationship in the event of a serious or repeated breach of these terms.

When the account is deleted, some of the connected content is deleted with it; other content remains and loses its link to the account. The Privacy Policy describes this in more detail.

23. Applicable law and dispute resolution

German law applies. Mandatory consumer protection provisions of the state in which a consumer is habitually resident remain unaffected.

Whether the operator takes part in proceedings before a consumer arbitration body has not yet been decided. The statement will be added to the imprint once the decision has been made.

24. Changes to these terms

These terms carry a version number and a date. Both are given at the top of this page.

Changes are announced in good time. Where a particular version is accepted, we record which version was accepted, in which language and at what time.

The German version governs; the versions in other languages are translations of the same version.
